DEFENSE ACTION AGAINST ENFORCEMENT IN GERMAN ENFORCEMENT LAW

چکیده
Alman hukukunda cebri icraya konu bir belgede yer alan alacağın maddi hukuk boyutunda meydana gelen ve belgenin icra edilebilirlik özelliğini etkileyen değişimlerin ileri sürülmesi ZPO § 767’de düzenlenen karşı dava ile mümkündür. Borçlu edilebilir gösterilen alacak hakkına yönelik 767/II-III’deki sınırlamalara uygun olarak hukuka dayanan itirazlarını sürebilmekte bu davada alacağı ilam ortadan kaldırabilmektedir. İcraya davanın açılmasının takibi üzerinde doğrudan etkisi bulunmamaktadır. Bununla birlikte gerekli şartların sağlanması halinde nihai karara kadar geçerli olmak üzere 769’da anılan karardan sonra 770’te takibine tedbirlere karar verilebilmektedir. Çalışmamızda Türk hukukundaki menfi tespit davası benzer işlevi yerine getiren esas itibarıyla tanıtımı yapılacak açıklanacaktır. aynı zamanda genel ülkemiz düzenlemeler çerçevesinde kısa değerlendirilmesi yapılacaktır.
